These Terms of Service ("Terms") constitute a legally binding agreement between you and PlayFlux Pro ("we", "us", or "our") governing your access to and use of the AI video and image generation platform available at https://playfluxpro.app (the "Service"). By creating an account, signing in through Google, Discord, or Telegram, purchasing credits, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility & Age Requirement
You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to access or use the Service. The Service contains adult-oriented AI-generated synthetic media. By using the Service, you represent and warrant that you meet this age requirement and that your use complies with all applicable local, national, and international laws.
2. Account Registration & OAuth Login
You may register and sign in using third-party OAuth providers, including Google, Discord, and Telegram. When you choose OAuth login, we receive limited profile information from the provider (such as display name, email address when made available, avatar image, and a unique provider user ID) solely to create and maintain your account. You are responsible for maintaining the confidentiality of your session and for all activity under your account. You must not impersonate others, share your account credentials, or use another person's account without authorization. We may suspend or terminate accounts that violate these Terms.
3. Description of the Service
The Service provides AI-powered tools to generate, edit, and export synthetic video and image content using credits. Features, models, templates, and pricing may change at any time. We do not guarantee uninterrupted availability, specific output quality, or compatibility with every device or browser.
4. Credits, Subscriptions & Payments
Certain features require credits or paid plans. Pricing, credit costs, and package details are displayed at checkout. New users may receive promotional credits upon first registration, subject to change. Purchased credits and subscriptions are generally non-refundable and non-transferable except where required by applicable law or explicitly stated at purchase. Failed generations caused by documented platform errors may be reviewed for credit restoration at our sole discretion. Payment processing is handled by third-party providers (such as Stripe, Wooshpay, NOWPayments, or Telegram Stars); we do not store full payment card numbers on our servers.
5. Acceptable Use & Prohibited Content
You agree not to use the Service to: (a) generate, upload, or distribute child sexual abuse material (CSAM) or any depiction of minors in sexual contexts; (b) create non-consensual intimate imagery (NCII), unauthorized deepfakes of real individuals, or content that violates another person's privacy or publicity rights; (c) infringe copyrights, trademarks, or other intellectual property; (d) harass, threaten, defame, or harm others; (e) distribute malware, scrape the Service, bypass rate limits or safety filters, or attempt unauthorized access; (f) violate any applicable law or regulation. See our Acceptable Use Policy and Content Guidelines for additional rules. Violations may result in immediate termination, forfeiture of credits without refund, and referral to law enforcement where appropriate.
6. User Content, Inputs & AI Outputs
You retain ownership of prompts, uploads, and other inputs you provide, subject to third-party rights. Subject to your compliance with these Terms and applicable law, we grant you a limited, non-exclusive, non-transferable license to use outputs you generate through the Service for personal or commercial purposes as permitted by your plan. AI outputs may be inaccurate, incomplete, or inappropriate; you are solely responsible for reviewing outputs before publication or commercial use. We may use automated systems to detect abuse and may remove or block content that violates our policies.
7. Intellectual Property of the Service
The Service, including its software, design, branding, templates, and documentation (excluding your inputs and lawful outputs), is owned by us or our licensors and protected by intellectual property laws. You may not copy, modify, reverse engineer, or create derivative works of the Service except as expressly permitted by law.
8. Third-Party Services
The Service integrates with third-party providers including OAuth platforms (Google, Discord, Telegram), cloud infrastructure (Cloudflare), AI inference providers, and payment processors. Your use of those services may be subject to their separate terms and privacy policies. We are not responsible for third-party services outside our reasonable control.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI OUTPUTS WILL BE ERROR-FREE, LEGAL FOR YOUR INTENDED USE, OR FREE FROM OFFENSIVE OR HARMFUL CONTENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) USD $50.
11. Indemnification
You agree to indemnify, defend, and hold harmless us and our affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.
12. Account Termination & Suspension
You may stop using the Service at any time and may request account deletion through the Service or by contacting support. We may suspend or terminate your access immediately if you violate these Terms, pose a security risk, or if required by law. Upon termination, your right to use the Service ceases; provisions that by nature should survive (including payment obligations, disclaimers, limitations of liability, and indemnification) will survive.
13. Changes to These Terms
We may modify these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Material changes may also be communicated through the Service or by email where appropriate. Your continued use after changes become effective constitutes acceptance of the revised Terms.
14. Governing Law & Disputes
These Terms are governed by the laws applicable in our principal place of business, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall first be attempted to be resolved informally by contacting us. If informal resolution fails, disputes shall be resolved through binding arbitration or courts of competent jurisdiction as required by applicable law.
